Quick answer: Once the donee accepts a registered gift deed, the donor generally cannot cancel it alone. Under Section 126 of the Transfer of Property Act, only a court can set it aside, for an agreed revocation event, fraud, coercion or undue influence. Senior citizens may also seek cancellation under Section 23 of the Senior Citizens Act.
Families often fall out after a parent gifts a house. Cancellation of gift deed in India is possible, but only on narrow grounds. Moreover, the donor cannot simply register a cancellation deed. This guide explains the law, the steps and the latest Supreme Court rulings.
Can a Registered Gift Deed Be Cancelled in India?
Section 122 of the Transfer of Property Act, 1882 defines a gift as a voluntary transfer without consideration that the donee accepts. Once the donee accepts it, ownership passes. After that, Section 126 allows revocation in only two situations.
- Agreed event: donor and donee agreed that a specified event, not dependent on the donor’s will alone, would suspend or revoke the gift.
- Contract-type grounds: the law would let a party rescind it as a contract, for example for fraud, coercion, undue influence or misrepresentation.
In addition, the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 gives elderly donors a separate, faster remedy.
Grounds for Cancellation of Gift Deed
Courts usually accept these grounds:
- A revocation clause or condition in the deed itself, agreed by both parties.
- Fraud, coercion, undue influence or misrepresentation at the time of signing.
- No valid acceptance by the donee during the donor’s lifetime.
- For a senior citizen, a gift made on a condition of care, followed by the donee’s failure to provide it.
However, mere regret or a family quarrel is not enough.
How to Cancel a Gift Deed: Step-by-Step
- Review the deed. Check for a revocation clause, care conditions and proof of acceptance.
- Collect evidence. Gather witness accounts, undertakings and proof of neglect.
- Send a legal notice. A notice records your grounds and may prompt a voluntary reconveyance.
- Choose the forum. File a civil suit for cancellation under Section 31 of the Specific Relief Act, 1963. Alternatively, a senior citizen may apply to the Maintenance Tribunal under Section 23.
- Seek interim relief. Ask for an injunction so the donee cannot sell or mortgage the property.
- Record the decree. Send the decree or tribunal order to the Sub-Registrar and update mutation records.
Timing matters too. Article 59 of the Limitation Act, 1963 generally allows three years from the date the plaintiff learns the facts.
Key Supreme Court Judgments on Gift Deed Revocation
N.P. Saseendran v. N.P. Ponnamma (2025 INSC 388, March 2025): A father cancelled a 1985 gift to his daughter and later sold the property to his son. The Court held that registration and the daughter’s receipt of the deed proved acceptance. Therefore, the unilateral cancellation and the later sale were both void. The Court added that a valid gift does not need delivery of possession.
N. Thajudeen v. Tamil Nadu Khadi and Village Industries Board (2024 INSC 817, October 2024): The donee left the gifted land unused for its stated purpose. Even so, the Court refused revocation because the deed reserved no such right.
Urmila Dixit v. Sunil Sharan Dixit (2025 INSC 20, January 2025): A mother gifted her house to her son, who signed an undertaking to care for her. When he neglected her, the Court quashed the gift under Section 23. It also confirmed that Maintenance Tribunals can restore possession. Earlier, Sudesh Chhikara v. Ramti Devi (2022) required the parent to prove the care condition.
Delhi, UP and Haryana Practice
In Delhi, a donor files a cancellation suit in the district court where the property lies, and senior citizens approach the district Maintenance Tribunal. UP and Haryana apply the same central laws, but tribunal procedure follows each state’s own rules.

FAQs on Cancellation of Gift Deed
Can a donor cancel a registered gift deed unilaterally?
No. After acceptance, only a court or, for senior citizens, a Maintenance Tribunal can set it aside.
What is the time limit to challenge a gift deed?
Generally, the donor must file a civil suit within three years of learning the relevant facts, under Article 59 of the Limitation Act.
Can parents take back property gifted to children?
Yes, in some cases. If the parent made the gift on condition of care and the child neglects them, the parent can seek cancellation under Section 23 of the Senior Citizens Act.
Is possession necessary for a valid gift deed?
No. The Supreme Court held in 2025 that registration and acceptance can complete a gift without delivery of possession.
Can the donor revoke a gift deed if the donee misuses the property?
Not by itself. Unless the deed reserves a right to revoke on that event, misuse does not justify cancellation.
