Quick answer: Mutation of property in Delhi updates the owner’s name in MCD property tax records or, for revenue land, in the Tehsildar’s records. For transfers registered after 1 April 2019, MCD mutation is largely automatic online. Mutation is only a fiscal entry: the Supreme Court holds that it neither creates nor extinguishes title.
Mutation of property in Delhi is the step most buyers and legal heirs forget after registration. Yet a missing entry can block resale, utility transfers and bank loans. This guide explains the MCD and revenue routes, the documents you need, how courts treat mutation, and how Delhi practice differs from UP and Haryana.
What Is Mutation of Property in Delhi?
Mutation records the change of owner in government records after a sale, gift, will or inheritance. In Delhi, two separate systems exist. First, urban houses and flats in MCD areas follow the property tax route, linked to the property’s UPIC number. Second, agricultural and revenue land follows the Delhi Land Reforms Act, 1954, through the Tehsildar of the revenue district. Properties under DDA, L&DO or NDMC follow their own procedures.
How to Apply for Mutation of Property in Delhi: Step by Step
In December 2022, the MCD moved property tax mutation fully online. For transfers registered on or after 1 April 2019, the system triggers mutation automatically, and you can download the certificate from the portal. If that does not happen, follow these steps:
- Log in to the MCD property tax portal with your UPIC or registered mobile number.
- Choose the option to request transfer of the UPIC to the new owner.
- Upload the transfer document, ID proof and up-to-date tax receipts.
- Submit the notarised affidavit and indemnity bond.
- Track the status under the e-mutation section until the zonal officer approves it.
For revenue land, you apply to the Tehsildar instead. The Tehsildar then issues a public notice inviting objections. If nobody objects, the Tehsildar sanctions the mutation. If someone objects, the SDM decides the case, and an aggrieved party can appeal to the Deputy Commissioner.

Key Case Law on Mutation of Property
Courts consistently treat mutation as a revenue entry, not proof of ownership. In Jitendra Singh v. State of Madhya Pradesh (September 2021), the Supreme Court held that a mutation entry confers no right, title or interest. Its purpose, the Court said, is only fiscal, so a title dispute must go to a civil court.
Next, in Tarachandra v. Bhawarlal (2025 INSC 1485, 19 December 2025), the Court allowed mutation based on a will. However, it added that revenue officers cannot decide a serious dispute over the will’s genuineness; such disputes belong in a civil court.
Most recently, in Jamnabai v. Vasudev (2026 INSC 900, 20 August 2026), the Court restored heirs’ co-ownership. It ruled that a revenue entry neither creates nor extinguishes title, so a party must prove the underlying transfer independently.
In short, mutation helps you pay tax and deal with authorities. Only a registered deed or a court decree proves title. That is why buyers should still run full title checks, as explained in our guide on checks before buying property in Delhi NCR.
Delhi vs UP and Haryana
Practice differs across the NCR. In Uttar Pradesh, mutation (dakhil kharij) runs under Sections 34 and 35 of the UP Revenue Code, 2006. A July 2025 state order set a 45-day deadline for undisputed cases and 90 days for disputed ones. In Haryana, the Patwari enters the mutation (intkal) and a revenue officer attests it. Meanwhile, Noida and Gurugram flats also need transfer in the development authority’s records.
Frequently Asked Questions
Does mutation prove ownership of property?
No. Mutation only updates fiscal records. Ownership rests on a registered deed, a will, succession or a court decree.
Is mutation compulsory in Delhi?
For practical purposes, yes. Without it, tax bills stay in the old owner’s name, and resale, loans and utility transfers become harder.
How long does mutation take in Delhi?
Auto-mutation for post-2019 registered transfers is usually quick. Revenue land mutation commonly takes about a month, including the objection period.
Can legal heirs get mutation without a will?
Yes. Heirs can apply with the death certificate and a succession certificate or other proof of heirship. Any rival heir may object.
What can I do if my mutation is rejected?
You can appeal to the higher revenue authority within the prescribed time. Where the dispute concerns title, you should file a civil suit for declaration.
