Quick answer: A legal notice to builder is a formal demand, sent through an advocate, asking the developer to hand over possession, refund your money or pay delay interest within 15 to 30 days. The law does not make it compulsory before a RERA or consumer complaint, but it fixes your demand and builds evidence.
A legal notice to builder is often the first serious step a homebuyer takes when a project stalls. It tells the developer exactly what you want, by when, and what you will do next. In Delhi NCR, a well-drafted notice also shapes the RERA or consumer case that may follow. Here is when to send one and what it must say.
When Should You Send a Legal Notice to Builder?
You should consider a notice when the builder misses the possession date in your agreement. It also helps when the builder raises unlawful demands, cancels your allotment or refuses a refund. Decide your main relief first. You can either stay in the project and claim delay interest, or withdraw and seek a full refund.
That choice matters. Section 18 of the RERA Act gives an allottee who withdraws a right to a refund with interest. In Newtech Promoters and Developers v. State of U.P. (2021), the Supreme Court described this refund right as unconditional when the promoter fails to deliver on time. If you stay instead, you can claim interest for every month of delay until possession.
What a Legal Notice to Builder Must Contain
A strong notice is short, factual and specific. It should include:
- Your name and address, and the builder company’s name, registered office and directors.
- The project, unit number, RERA registration number and date of the builder buyer agreement.
- A payment table showing each instalment and receipt.
- The promised possession date and the length of the delay.
- Earlier emails, letters and the builder’s replies.
- The relief you demand: possession with interest, or refund with interest and compensation.
- A clear deadline, usually 15 to 30 days, to comply.
- The forum you will approach next, such as the State RERA or the consumer commission.
Your advocate should sign the notice and send it by registered post or speed post, and also by email. Keep the receipts as proof of service.
Step-by-Step: After You Send the Notice
First, wait for the deadline to expire. Next, review any reply carefully, because builders often plead force majeure or blame approvals. If the reply is evasive, file your complaint. In Delhi, the complaint goes to Delhi RERA. In Noida and Ghaziabad, you file online with UP RERA. In Gurugram, HRERA Gurugram hears it. Many buyers also brief real estate dispute lawyers in Delhi NCR at this stage.
One exception deserves attention. If your dispute is with a government body such as a development authority, Section 80 of the Code of Civil Procedure requires two months’ notice before a civil suit. This rule does not apply to private builders.
Key Case Law on Builder Delay Claims
- Newtech Promoters v. State of U.P. (Supreme Court, 2021): The Court treated the allottee’s Section 18 refund right as unconditional when the promoter defaults on possession.
- Rajnesh Sharma v. Business Park Town Planners Ltd (Supreme Court, 24 September 2025): The buyer sent a legal notice after the builder refused a refund. The Court then raised refund interest from 9% to 18%, matching what the builder had charged the buyer for late payments.
- Madhu Kudapa v. Lodha Healthy Constructions (2026 INSC 1131): The Court held that a buyer cannot claim both refund interest and rent for the same delay. It awarded 12% interest plus a lump sum for harassment and costs.
These rulings show why your notice must claim the right relief. Ask for interest and compensation, but avoid overlapping heads that a court will later strike down.
Frequently Asked Questions
Is a legal notice mandatory before filing a RERA complaint?
No. Neither the RERA Act nor the Consumer Protection Act, 2019 requires a prior notice. Still, a notice records your demand and often prompts a settlement.
How many days does a builder get to reply to a legal notice?
No statute fixes the period for private builders. Most notices allow 15 to 30 days, and you can then file your complaint.
What happens if the builder ignores the legal notice?
You can file a complaint before the State RERA or the consumer commission. The builder’s silence also helps show that you tried to resolve the dispute first.
Can I claim interest in a legal notice to builder?
Yes. You can claim delay interest if you stay, or refund with interest if you withdraw. State RERA rules link the rate to the SBI lending rate.
Can I send a legal notice to builder without a lawyer?
Yes, you can write it yourself. However, an advocate’s notice usually carries more weight and avoids admissions that may hurt your later case.
