Quick answer: If your flat’s carpet area is smaller than the area in your agreement, the builder must refund the price of the missing area. Model RERA agreements require this refund within 45 days after the builder confirms the final area, with interest at the rate in the state Rules. You can enforce this claim through a RERA complaint.
Many buyers discover a carpet area shortfall under RERA only at possession, when an architect measures the flat. This guide explains what the law says, how Delhi, UP and Haryana regulators treat the issue, and how you can recover your money.
What Is Carpet Area Under RERA?
Section 2(k) of the Real Estate (Regulation and Development) Act, 2016 defines carpet area as the net usable floor area of an apartment. It excludes external walls, service shafts, exclusive balconies or verandahs and exclusive open terraces. However, it includes internal partition walls.
Earlier, builders priced flats on “super area”, which added a share of lobbies, lifts and other common spaces. RERA therefore requires promoters to disclose and sell units by carpet area.
Your Rights When the Carpet Area Shortfall Under RERA Arises
The model agreement for sale under the RERA Rules sets out a clear mechanism. After the occupancy certificate, the promoter must confirm the final carpet area and recalculate the total price. If the area shrinks, the promoter must refund the excess within 45 days, with interest from the date you paid it. In contrast, the promoter may charge extra only for an increase of up to three percent.
In addition, Section 14 of the Act bars a promoter from altering the plans of your apartment without your prior consent. A shortfall caused by an unapproved change can therefore support further claims for compensation.
How Delhi NCR Regulators Treat Super Area Sales
- Haryana (Gurugram): HRERA Gurugram notified its carpet area regulations in May 2021. They require new allotments on a carpet area basis only. They also treat any other basis as an unfair practice and allow penalties under Section 61.
- Uttar Pradesh: In January 2024, UP RERA directed all promoters to sell units by carpet area only. It warned that super area sales breach the Act.
- Delhi: Delhi RERA applies the same Section 2(k) definition and the same duties under the Act. So, compare your agreement with the area disclosed on the RERA portal.
Key Case Law on Carpet Area Disputes
- Nitin Malhotra v. Elan Buildcon Pvt. Ltd. (Haryana Real Estate Appellate Tribunal, 18 January 2025): The promised unit turned out to be about one-sixth of its super area. The Tribunal set aside a 10% deduction and ordered a full refund with interest within 90 days.
- HRERA Gurugram order on Signum-93 (reported March 2024): The Authority held the builder liable for pricing a shop on super built-up area. It ordered a refund with interest under Rule 15 of the Haryana Rules.
- Supreme Court, 12 January 2021 (bench led by Justice D.Y. Chandrachud): The Court dismissed a builder’s appeal against an NCDRC order. The NCDRC had quashed a demand for extra money for an unproven increase in super area.
- NCDRC, 8 December 2021: The Commission ordered a Mumbai builder to refund the shortfall at the agreed rate.
Note, however, that regulators enforce signed terms. In 2021, MahaRERA dismissed a carpet area claim because the buyer had signed a letter accepting possession without further claims.
Step-by-Step: How to Claim a Carpet Area Refund
- Check your agreement: Note the carpet area, the rate per square foot and any variation clause.
- Get an independent measurement: Ask an architect for a signed report under Section 2(k).
- Demand the final area statement: Ask the builder for its confirmed carpet area and the approved plans.
- Do not sign blanket waivers: Record your objection in writing before you take possession or sign any “no claims” letter.
- Send a legal notice: Claim the refund with interest at the rate in your state Rules.
- File a RERA complaint: Approach the RERA authority of the state where the project sits. See our guide on how to file a RERA complaint against a builder.
